New Regulations for Fragrances in Cosmetics

The field of analysis and declaration of allergenic fragrances in cosmetics is currently in a state of flux.

In general, certain fragrances a certain amount in cosmetics have to be declared above (according to Annex III of Regulation (EC) No. 1223/2009: 10ppm for leave-on products, 100ppm for rinse-off products), the use of individual fragrances is even prohibited or will be prohibited according to Annex II of Regulation (EC) No. 1223/2009.

 

From 23.8.2021 at the latest, cosmetics containing any of the fragrances atranol, chloratranol or hydroxyisohexyl-3-cyclohexene carboxyaldehydes (Lyral) may no longer be sold. Furthermore, a sales ban will also take effect for the fragrance butylphenyl methylproprional (Lilial) from March 2022.

 

An amending ordinance is under discussion and is expected to be passed in the first quarter of 2022. This ordinance will designate approx. 50-60 additional fragrances beyond the currently regulated fragrances, with a corresponding obligation to declare them. The basis for this is an SCCS Opinion, which comes to the conclusion that the declaration of further fragrances is necessary with regard to preventive health protection.
